I can't speak for WA, but last time I checked it was still part of the
United States.  I think you'll find that most, if not all the states, have a
provision in their laws for driving under the influence of controlled
substances.  Any PWP involved in an accident due to a "sleep attack" would
likely be liable for any damages he/she caused, but I highly doubt that they
would ever be prosecuted criminally for DUI.  Unless you were guilty of some
deliberate misuse of your medication.  However, you may be charged with some
lesser traffic offenses.
Most police depts. have a hard enough time getting a conviction on an
alcohol related DUI, much less one involving prescription drugs that they
can't even pronounce, or have equipment to test for.
In any event, if this happens to anyone I would advise (not legal advice, I
am no attorney, only my opinion) you invoke your Miranda right of remaining
silent.

Folks, Please be careful. In Washington state sleeping at the wheel due to
prescription medications is called "driving under the influence" (DUI) and
is punishable the same as someone who is driving drunk.
