The answers to your questions can be found only in your company's disability
insurance policy.  Your situation is unusual, and it sounds like the
disability insurance company (communicating with you via the insurance agent)
is giving themselves the benefit of the doubt in order to save $$$.  You need
a knowledgeable person who's going to look at this with your rights (not the
insurance company's bottom line) as top priority.  For fastest results, go to
an attorney who specializes in employees' rights (or possibly insurance law)
and give him a copy of your employer's disability insurance policy and
personnel handbook.
