Basically the judge ruled against the trial participants on the basis of
contractual issues -- that the informed consent form they signed at the
beginning of the trial did not require Amgen to continue their treatments
after halting the trial.

None of the other issues - the contested trial results, the questions
about the safety issues being overstated, nor the morality of denying
treatments that worked for many of  trial participants  were considered
in the judge's decision.

This case should teach all of us that before enrolling in future clinical
trials we should very carefully consider what's included or not included
in the informed consent forms .This is an issue the Parkinson Pipeline
Project is working on, along with a  "Research Participants' Bill of
Rights"
